Delta 8 is a hot topic right now across the internet. Many have done research and have chosen to delve into this cannabinoid and experience the benefits for themselves. The question is, is Delta 8 legal, and where can you get it?

Delta 8

Delta 8 is a psychoactive cannabinoid that creates a small high in its consumers. This high is more controlled and keeps consumers in a lucid and functioning state of mind, unlike Delta 9. Delta 9 is the main psychoactive cannabinoid found within cannabis. It creates a high in consumers. Consumers occasionally report being too high or experience unwanted side effects, like increased paranoia and anxiety. Delta 8 doesn’t typically come with any side effects. It still relaxes and creates a sense of euphoria consumers. Some report that they prefer Delta 8 over other products on the market, like Delta 9 and CBD

Federally Legal

On a federal level, Delta 8 is legal thanks to the USDA’s Farm Bill. Delta 9 as a Schedule 1 drug, meaning that it can be a highly addictive drug and considered dangerous. But if a product contains 0.3 percent or less of Delta 9, it’s classified as industrial hemp. Industrial hemp is federally legal and available to the general public. Delta 8 is structurally different from Delta 9, making them completely different compounds. So, Delta 8 is legal because it contains less than 0.3 percent of Delta 9. But just because it is federally legal doesn’t mean that it is legal on the state level. States have put their own rules and regulations together when it comes to Delta 8.

Alabama State Law

According to Alabama state law, Delta 8 is a legal substance for people to have and consume. 

The law states:

“INDUSTRIAL HEMP or HEMP. The plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, cultivated or possessed by a licensed grower 9; otherwise in accordance with the state’s USDA-approved regulatory plan, whether growing or not, with a delta 9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Industrial hemp shall be considered an agricultural crop or an agricultural commodity, or both, in all respects under state law.”

This breaks down the definition of hemp, where Delta 8 is derived from. Because Delta 8 is defined as hemp under Alabama state law and contains less than 0.3 percent of Delta 9, it is legal in the state. Laws are always subject to change, so always research the rules and regulations in your state before purchasing any Delta 8 products.
