Trying to figure out if a product containing Delta 8 is legal or not can be confusing and overwhelming. Here, we try to break down the law to make it easier to understand. Plus, we want to show you exactly where the laws stand. Let’s take a look at Georgia State and their laws on Delta 8.

Farm Bill

 In 2018 the Farm Bill was passed by the USDA, which states that all industrial hemp, whether growing or not, and contains less than 0.3 percent of Delta 9 within the final product, then it is legal to sell and consume on a federal level. Delta 9 is the main cannabinoid found within the cannabis plant that causes the high that consumers seek. 

Each of these cannabinoids are different from one another on the molecular level. Delta 8 has a double bond on the 8th carbon chain. Delta 9 has a double bond on the 9th carbon chain. This difference is what makes Delta 8 still have the same effects as Delta 9 to a less potent degree. This is what makes Delta 8 legal on the federal scale. 

But just because a product is legal on the federal level does not mean that it is legal on the state level. Each state has their own rules and regulations. So what about Georgia?

Georgia Law

Georgia State Law follows closely to the Farm Bill rules, which means that Delta 8 is legal within the state. The law says

“‘Hemp products’ means all products with the federally defined THC level for hemp-derived from, or made by, processing hemp plants or plant parts that are prepared in a form available for legal commercial sale”

“Federally defined THC level for hemp’ means a delta-9-THC concentration of not more than 0.3 percent on a dry weight basis.”

So Georgia State Law closely follows the Federal Law passed in 2018. As long as a product contains less than 0.3 percent of Delta 9, then it is legal to sell to the general public. However, there’s been some recent concerning Georgia over Delta 8. It could be risky to purchase at this time.
