Laws can be incredibly confusing, with their long winded sentences and their repetitive language can add to the lack of clarity laws create. So, let’s try to break it down and look at the laws set in place in regards to cannabinoids found within the cannabis plant, including Delta 8, one of the newer cannabinoids available to the general public. Let’s see what Hawaii says about Delta 8.

Federal Law

The first thing to define is the federal law when it comes to cannabinoids like Delta 8. As long as a product, created with industrial hemp, contains less than 0.3 percent of Delta 9, then the product is legal to sell to the general public. This was stated in the Farm Bill, passed in 2018 by the USDA. 

This definition helped create the hemp industry and cannabinoid usage what it is today. Because of the Farm Bill, the hemp industry grew to be worth 1.9 billion dollars at the end of 2019 and is expected to grow to 10.4 billion dollars by the end of 2024, just 5 short years later.

While this bill can open up a whole new industry, with large amounts of revenue, growth, and jobs for the American people, it doesn’t mean that every state agrees or follows this bill. Each state has their own rules and regulations when it comes to cannabinoids. 

Hawaii State Law

So, what does Hawaii state law say about cannabinoids? Hawaii has updated their state law to reflect the definition of Delta 8 along with other cannabinoids. Hawaii now defines hemp as: 

“‘Hemp’ means all parts of the plant Cannabis sativa L., whether growing or not, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis, as measured post-decarboxylation or by other similarly reliable methods.“

Delta 8 is considered hemp because its a cannabinoid synthesized in a lab. This is in order to create enough product a viable substance for consumption. Delta 8 also doesn’t contain any Delta 9 because each delta is structurally different on the molecular level. 

The difference comes in the form of double bonds. There’s a double bond on the 8th carbon chain for Delta 8. There’s also a double bond on the 9th carbon chain for Delta 9. Because of this structural difference, Delta 8 will naturally contain less than 0.3 percent of Delta 9 within them.
