There has been quite the stir lately around the hemp industry. Not only has hemp been classified as federally legal, but the hemp industry continues to grow and create new products. One product that has been taking the industry by storm are products infused with the cannabinoid Delta 8. Similar to Delta 9, the main psychoactive cannabinoid in marijuana that creates the euphoric high consumers aim for when they consume cannabis, Delta 8 creates a less potent and more controllable high in consumers. Many have reported that they feel relaxed and focused after taking Delta 8 products.

What’s the difference between Delta 8 and Delta 9 though? On the molecular level, they are almost identical except for a difference of a double bond on the carbon chain. Delta 8 has a double bond on the 8th carbon chain. Whereas Delta 9 has a double bond on the 9th carbon chain. This difference is how Delta 8 is more controllable and quickly becoming a top choice for consumers. 

Federal Law

How is Delta 8 legal? Back in 2018, the USDA passed what is known as the Farm Bill. Within this bill, hemp and marijuana were defined separately, which hadn’t been done since the 1970s. Back then, the Controlled Substances Act was created and cannabis as a whole was placed on it as a Schedule I drug. Schedule I drugs are classified as the ones that are most likely to be abused and pose the most danger to the general public. But now that hemp and marijuana are classified separately, a whole new industry has opened up for hemp products. The Farm Bill states that:  

“The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”

As long as the final form of a product contains less than 0.3 percent of Delta 9 within it, then it is legal to sell to the general public on the federal level. This does not mean that hemp is legal in every state. Each state gets to create its own laws and regulations when it comes to hemp. It’s how some states have legalized medical marijuana use and others haven’t. So what Delta 8 laws does Oklahoma have?

Oklahoma State Law

Like many other states, Oklahoma has adopted the same definition of hemp stated in the Farm Bill. As long as the product contains less than 0.3 percent of Delta 9 in the final form, then it is legal to grow, sell, and consume within the state. This makes Delta 8 legal in Oklahoma. The law further states:

“‘Marijuana’ means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin, but shall not include:…

c. any other compound, manufacture, salt, derivative, mixture or preparation of such mature stalks (except the resin extracted therefrom), including cannabidiol derived from mature stalks, fiber, oil or cake”
