Delta 8 Products Only Sold at Licensed Businesses in Michigan

In July, Governor Gretchen Whitmer, D, signed a bill requiring the regulation of all THC products, including Delta 8. Beginning October 11, only licensed cannabis businesses can sell products containing any THC. This is to help ensure all products are safe and to confirm the manufacturing process is safe as well. 

Therefore, it is illegal for businesses to manufacture, possess, transfer, inventory, sell, or give away Delta 8 or THC-O acetate without licensing and approval from the Marijuana Regulatory Agency (MRA) according to Michigan state law

“Michigan’s approach to cannabis is a model for the nation in regard to protecting its residents and making sure that those who consume these products do so in a safe manner,” said MRA Executive Director Andrew Brisbo. “Moving forward, these intoxicating products will be removed from the unregulated marketplace and placed in a well-regulated and licensed system, restricted to adults, and monitored for safety.”

Further Law Changes

In addition to the new regulation and sale of Delta 8, other laws went into effect on October 11. Those include:

  • Licensees can’t sell or transfer cannabis to a minor or to a person visibly intoxicated at the time of the sale. 
  • Cannabis retailers and microbusiness licensees must have and maintain cannabis liability insurance. 
  • Telemedicine is allowed for Michigan residents participating in the state’s medical cannabis program.

Delta 8 Laws

Federally, Delta 8 is legal under the 2018 Farm Bill. It states as long as cannabinoid products contain no more than 0.3 percent Delta 9, then they are legal to produce and sell. Delta 8 is structurally different from Delta 9 on the molecular level thanks to a difference in double carbon bonds. That means Delta 8 products naturally contain no more than 0.3 percent Delta 9 in them.

That hasn’t stopped some states from limiting or banning the production, sale, and consumption of Delta 8. Those states are: Alaska, Arizona, Colorado, Delaware, Idaho, Iowa, Montana, Nevada, New York, North Dakota, Rhode Island, Utah, and Vermont

For now, the rest of the U.S. offers legal Delta 8 under their state laws. However, those are always subject to change. Michigan isn’t banning Delta 8, but rather regulating the manufacturing process. Should more states regulate, limit, or ban Delta 8 production, we will update you with the latest.
